Mother Faces First Degree Murder Charges

The trial of a Long Beach, CA mother charged with first-degree murder in the gang-related stabbing death of a 13 year-old boy is underway. Prosecutors claim that Eva Daley, 31, was seeking revenge against the boy and his gang for an incident that occurred near Daley’s home on the same day the boy was killed.

 

Daley is accused of aiding and abetting the murder of Jose Cano by driving her son and six of his friends to a skate park where the fatal confrontation took place. Daley’s son and his friends allegedly jumped from her SUV and chased down the victim, beating him while another member of the group stabbed him to death.

Defense attorneys say that Daley was unaware that the teens in her vehicle were armed and could not have known what would happen to the victim. If convicted, Daley faces 25 years to life in prison. Daley’s co-defendant, Herbierto Garcia, 17, is also facing first-degree murder charges and is being tried as an adult. Five other youths charged in the case have pleaded guilty to manslaughter and are in the custody of the Department of Corrections’ Division of Juvenile Justice.
