7 Year Old Saves His Family

The story of young Carlos, a seven year old, who called the police when three armed men entered his home is amazing.

It reads like a movie, three men broke into the home of the family of four and trained guns on the parents. Seven year old Carlos grabbed his little sister and ran to the bathroom where he locked the door and called 911. After pleading with the operator “Can you come really fast? Please, please!”, he explained to her the crime that was occoring.

As the operator listened and sent help, she had to listen to the moment when the robbers broke through the door and grabbed the children. She could hear screaming and descibed the incident as unbearable. “I still hear his little voice on the phone. Just hearing them screaming and crying for help, I just felt the fear through the phone.”

The three suspects are still at large but the LAPD is tracking down every lead.

Carlos did make it clear that the screaming that can be heard on the 911 tape was not him, “It was my sister!” he explained loudly.

Jury Recommends Death For Alcala

We have followed the case of Rodney Alcala in the past couple of months. Today the jury in his case said they think he should be put to death.gavel

Rodney has been convicted of serial rape and murder of five women in the Los Angeles area. The crimes took place between the years of 1977 and 1979. The jury was only out an hour before coming back with their death penalty decision.

He will have his sentencing hearing on Wednesday where prosecutors fully expect the judge to take the recommendation and make Alcala pay for his crimes with his life.

Alcala acted as his own lawyer during the case and was said to have displayed bizarre behavior and was fixated on one detail of a single victim’s case while ignoring the others.

Other than the obvious, a lesson that can be learned from this case is that you have to have a great lawyer in any case, especially a murder case in California. Because the death penalty is permitted in that state, you must be able to literally trust your attorney with your life. Los Angeles Attorney Robert Helfend has been trusted on that level many times and has seen his clients get their lives back and charges dropped on multiple occasions. Review his case files and then contact him if you know of anyone in need of a great defense attorney.

Teacher Confesses to Affair with Student

On Wednesday, Anna Victoria Beck walked into a Los Angeles Police Department and confessed to having slept with a fourteen year old student.

Apparently this well respected middle school teacher told Sgt. Robert Quesada that she and the young boy had a sexual photo_382_20051108relationship for about nine months. She said, with her lawyer by her side, that the affaid left her with so much guilt that she decided to turn herself in.

“I can’t tell you that I remember anything like that ever happening before,” Quesada said “But when people are overwhelmed with guilt, and they have a conscience, I guess it makes them do what’s right.”

The now 15 year old boy has been tracked down and confirmed the story.

The married mother of three is now in jail and although her bail has been set, she has made no effort to get the money and instead remains in custody.

In a situation like this a very trusting relationship with you attorney is vital. Obviously Anna and her lawyer talked things over and came up with the best plan for all involved and although she faces over seven years in jail, she took the path she wanted to take. Murder Conviction Overturned

In 2007 Marvin V. Smith, a wealthy liquor store owner from Cypress California, was convicted of killing his wife. At theUS Supreme Court Buildingtime it was believed that he killed his wife and staged an elaborate robbery scene to make it look like she was killed in the process of that act.

During the trial it came out that Smith had several affairs and that he gained several million dollars from his wife’s death. He also reported that over $200,000 in jewels had been stolen, those jewels were later found in the truck of a car he kept in a garage in a LA. The box that held the jewels was wrapped in the same duct tape that bound the victims limbs.

Today a three-justice panel found that Superior Court Judge Dan McNerney made errors that violated Smith’s right to a fair trial.

“On appeal, Smith asserts several claims of evidentiary and instructional error,” wrote Acting Presiding Justice William F. Rylaarsdam. “We agree. . . “

The panel also said that jurors had serious doubts about the case being that they asked to be able to review evidence concerning the supposition that Smith would have been unable to commit the crime because of shoulder surgery he’d undergone in the weeks prior to the incident.

He will now get a new trial and seems confident things will go his way.

This is the type of tenacity Los Angeles Defense Attorney Robert Helfend is known for. Teacher Punished for Pictures

photo_16356_20100120Three teachers have been suspended in South LA for having children carry posters of OJ Simpson, Dennis Rodman, and RuPaul in a Black History Parade.

All three white male teachers have been placed on administrative leave for giving children posters that the Superintendent of schools believe were meant to mock Black History.

“These are not the people we want our young people to emulate or believe these people represent the best of the African-American community,” Jenkins said. “It’s hard for the NAACP to believe this was a mistake.”

Other children were given pictures of President Barack Obama, Nelsen Mandela, and Harriet Tubman among other black heroes.

Some parents were outraged and complained to the NAACP, however others feel the incident was overblown. One mother, Sharon Tinson, who has two daughters in the school said that although she was surprised by OJ’s face, she realized he had a very prominent sports career as did Rodman before becoming better known for bad boy behavior like drinking and partying. She also stated that there is no reason RuPaul should not be celebrated as he simply has an alternative lifestyle.

The event also had a tribute to Michael Jackson who, although well loved, has a very tainted reputation.

“I kind of laughed at it,” Tinson said. “I wasn’t offended.”

Another parent, Gabriel Jackson said felt much the same way.

“These guys were heroes before. People make mistakes,” he said. “I think they show kids they can be somebody, to push them to be somebody.”

Inmates Getting released Early

Sheriff Lee Baca talks with reporters as he leads a tour inside the Mens Central Jail

Los Angeles County Sheriff Lee Baca says that he will release inmates earlier than expected. Most people convicted of a crime will only serve approximately eighty percent of their sentence. But this week Baca said that in an effort to address the $400 million budget deficit he will release most ‘lesser’ criminals who have only served about half the time they were sent to prison to serve.

Sheriff Baca says that the early release of criminals who have committed small crimes such as check forging, lower level drug use, drunk driving as well as a few others will save his county $128 million.

The Sheriff has come under some scrutiny recently when an audit showed that he and his staff have exceeded their overtime budget by about 104% every year for the past five years. They are now trying to make as many budget cuts as possible without endangering the citizens of Los Angeles. He will also to close part of the Pitchess jail in Castaic and cut way back on overtime for his patrolmen by patrolling one or two nights a month himself.

“We’re in a save our jobs mode,” he said. “I have no desire to have anybody lose their job in the Sheriff’s Department, so I think we can do the belt-tightening in a way that myself and my command staff all will be a part of this backfill of vacant positions that we normally use overtime to fill.”

Getting out of prison after only serving half of your sentence is a great thing, but not going to jail in the first place is even better. If you are charged with a crime call Attorney Robert Helfend for your best chance of getting your charges lowered or even dropped.

Arrest Made in the Chelsea King Case

On Thursday, 17 year old San Diego teen Chelsea King went for a jog and never returned home. On Tuesday, a body thought to be hers was found in a shallow grave near Lake Hodges. Over the weekend DNA found on King’s underwear found by the lake led authorities to sex offender John Albert Gardner III who was arrested in connection with the case.

Gardner is a registered sex offender because of a conviction in a case where he attacked a 13 year old girl. He served five years in prison and wore a tracking device until 2008. Although Gardner is a resident of Lake Elsinore, California, he was

visiting his mother in the San Diego area the week Chelsea went missing.

Not A Hit and Run Afterall

On Friday a thirteen year old girl was struck by two vehicles and rushed to the hospital where she later died. The horrible incident was first reported as a hit and run where two drivers ignored the fact they had hit the young women. However, upon further investigation the truth came out.

The truth is that Julia Siegler, an eighth-grader at Harvard Westlake School, was crossing the street at 7:20am on a red signal; she was then struck by the mirror of one car and then hit by the vehicle behind it that was driven by a juvenile. Bothphoto_4609_20080109 drivers got out at the chaotic scene and stayed with the victim until authorities arrived.

“At this point, we have not arrested nor have we booked either of the drivers,” Said Los Angeles Police Capt. Nancy Lauer. ”It appears to be a horrible accident.”

This tragedy could have been made much worse by the false accusal of these drivers who are clearly not at fault. Often police and prosecutors (who are only human) get it very wrong and people’s lives are put on the line.

Los Angeles Defense Attorney Robert Michael Helfend can help if you are ever falsely accused. No matter the circumstances anyone who is accused in a criminal case in the Los Angeles area should contact Mr. Helfend so he can set the record straight by getting to the truth.
